How to Legally Transfer Data Cross Border from China

Knowing how to transfer data outside of China legally is an important issue for multinational companies and Chinese companies with overseas business. On 1 September 2022, the Chinese government implemented newly promulgated rules controlling the transfer of data abroad, marketing a new step in Chinese campaign to tighten oversight over the digital space. 

China's Cybersecurity Law ("CSL"), Personal Information Protection Law ("PIPL") and Data Security Law ("DSL") set a series of rules and requirements for the cross-border transfer of data, especially Personal Information located in China. These rules and requirements have strong impacts on the business activities of companies operating in or investing in China. Data processors subject to the Chinese data protection laws will consider three mechanisms in planning for their data cross-border transfer: the security assessment, the China Standard Contractual Clauses, and the security certification.

During the webinar, our speakers, Allen Chen, Forensic Partner from Mazars in China, and Star Chen, our Forensic Director from Mazars in Hong Kong, will help you understand the pain-points companies experienced with obtaining Chinese government approval and implementing the Chinese SCCs for outbound data transfer and provide practical suggestions.

About the speakers

Allen manages the Forensic, Compliance and Cyber Security related services, including but not limited to anti fraud, anti bribery and anti corruption, commercial internal investigation, eDiscovery, ISO37301/ISO37001 certification advisory, compliance/cyber risk assessment and enhancement advisory, incident response and other compliance/cyber related services. He is one of the earliest eDiscovery experts and carried a lot of FCPA investigations with various top international and domestic law firms, for clients of the USA, Europe and SOEs listed overseas, among such engagements cross boarder coordination incurred and managed as routine job. 

 

Star has fifteen years of forensic accounting and investigation experience and has spent most of her career in leading accounting firms in Hong Kong, Beijing and the USA.  She is an experienced project manager with a focus on forensic accounting, fraud and corruption investigations, accounts misstatement, anti–money laundering compliance and advisory, and disputes. Additionally, she has experienced with the compliance function in fintech & banking industries.  
She has led proposals and delivering engagements on forensics engagements for listed and private companies in Hong Kong and Mainland China covering industries from financial services, private equity, technology, manufacturing, agriculture, medical devices.
