Hong Kong Competition Law Update
 
Since 2021, we have seen regulators around the world tightening enforcements of competition law and Hong Kong has seen an increase in activities since the start of 2022. 

During this webinar, Ashima Sood, Senior Associate from Gall Solicitors will provide an update the key developments in the competition law landscape, including with respect to the Commission’s recent enforcement efforts, the Court of Appeal’s latest ruling on pecuniary penalties, as well as the Commission’s policies regarding leniency, cooperation and commitments.

In particular, Ashima will touch upon the following:

Enforcement / compliance measures, such as infringement notices and commitments, being employed by the Commission.
The Court of Appeal’s findings in relation to the concept of an undertaking as the basis for determining pecuniary penalties, and the wider implication of this ruling on the potential legal liabilities on related companies.
The Commission’s new policy on Section 60 commitments, and factors which the Commission will take into account when deciding whether a commitment is appropriate.
The range of remedies available to the Commission in addressing potential violations of the competition rules.
The Commission’s key areas of focus in the coming years with regard to enforcement of the Competition Ordinance (Cap. 619).

 

 

About the speaker

Ashima joined Gall in September 2014. She has wide-ranging experience in commercial litigation, arbitration and dispute resolution, focusing on issues involving breach of contract, joint venture and shareholders’ disputes, asset tracing and Mareva injunctions, enforcement of judgments, as well as insolvency and bankruptcy matters.
Prior to moving to Hong Kong, Ashima was a practicing lawyer with Bharucha & Partners, a leading dispute resolution firm in India. She has also worked with the Advisory practice at KPMG (India) where she advised global financial institutions and private equity funds on anti-bribery and corruption risks.
