Working “From Home” While Overseas: Is It Legal?

Since the start of the Covid-19 pandemic, companies have seen a huge increase in requests from employees to work from home in another country for the short, medium and long term. This has been triggered by employees wanting to fly home to be close to family, wanting to work from holiday homes or getting stuck in a country due to flight restrictions and quarantine rules.

Although this may seem a sensible and/or kind solution in the circumstances, the creation of a temporary overseas workforce presents a list of potential pitfalls for companies. Before agreeing to such a request, companies should be mindful of the various legal implications of these “work from home, abroad” arrangements and weigh up the risk.

  • what employers need to know when evaluating requests to work from home abroad, including in relation to tax, local employment rights, immigration issues and data protection;

About the speakers

Kathryn is Head of Lewis Silkin in Hong Kong and Head of the Employment team. She is dual-qualified in Hong Kong and England & Wales and has specialised in employment law for over 12 years. Catherine works closely with legal, HR and senior executives and provides strategic advice on a full range of employment law issues including redundancies, bonus entitlement disputes, team moves and complex discrimination and sexual harassment cases.
