When a dispute arises between two or more parties, they can commence litigation. But how do you initiate proceedings? What should you consider before filing a claim? And how can you prepare if your case goes to trial?

Litigation can be time consuming and expensive, so anyone intending to explore it as a means for settling a dispute should be well-equipped and have a solid understanding of the various steps.

In this webinar, we will explore the various relevant considerations before commencing litigation in Hong Kong, how to commence litigation, as well as other aspects of the litigation process and the various types of alternative dispute resolution (ADR) available (including their pros and cons), such as arbitration and mediation.

About the speakers

Kenix Yuen is a Partner at Gall. She joined the firm in 2013 and specialises in cross-border commercial litigation and international arbitrations (in particular, involving element(s) of the People’s Republic of China) covering contractual disputes, shareholders’ disputes, directors’ duties, fraud and asset tracing, misrepresentation and mis-selling claims. She also has experience advising on regulatory investigations conducted by the Securities and Futures Commission and a regulatory inquiry from the Insurance Agents Registration Board. Before Gall, Kenix worked at another boutique litigation law firm. Prior to commencing her career as a solicitor, Kenix worked in the Legal and Compliance Department of an international bank and the individual tax team of one of the Big Four accounting firms.

 

Nick Dealy joined Gall as a Partner in January 2018 and has since specialised in commercial litigation (including cross-border disputes, contractual claims, fraud and misrepresentation)  as well as contentious regulatory matters. Prior to joining Gall, between 2000 and 2018, Nick held various roles in the Legal teams in UBS AG in London and Hong Kong, including the Head of Litigation and Investigations for APAC. Nick has extensive experience in complex and multi-jurisdictional matters, including those concerning the submission of reference rate and foreign exchange information, sponsorship activities in Hong Kong initial public offerings, and complex derivative and structured investment product disputes.
