How a new Online Dispute Resolution (ODR) platform can prevent an international business dispute from crippling your company

Foreign markets may open exciting new opportunities for an SME. But they also create new, and potentially crippling dangers linked with cross-border business disputes. The sober reality of business life is that the average company will find itself in a business dispute at least once in three years. Any dispute will on average take 450 days to resolve, with litigation costs running into millions of dollars.

The imminent launch by the eBRAM Online Dispute Settlement platform in Hong Kong promises radically to reduce and limit those dangers. Join us to find out more about this new initiative aimed at fast, user-friendly, cost conscious, reliable and confidential access to dispute resolution services for small companies and small claims.

Once running, the electronic Business Related Arbitration and Mediation (eBRAM) platform aims to bring significant changes to operations for small businesses across geographical borders, across languages and across cultures, helping them to minimise and avoid risks linked with doing global business, while at the same time offering training and nurturing of young, up and coming lawyers, mediators and arbitrators in Hong Kong and internationally. On top of building an e-platform to provide a cost effective alternative to settle disputes, eBRAM is developing proactive tracking of SME business deals to minimise the legal cost when disputes happen. This will leverage technologies such as blockchain and AI to track progress on business deals, right from the very beginning, generating alerts if anything unusual happens. Early notifications of exceptions can minimise and even entirely avert the danger of a dispute.  

 

About the speakers

Daniel Lam is currently the Chief Executive Officer of eBRAM Centre Limited.  He is an expert in property development and construction, specialised in urban renewal and developments above railway stations and depots, and is a practicing arbitrator.

Because of Daniel’s professional knowledge and interest in arbitration, he has been appointed as arbitrator in a number of cases.  He was a Council member of the Hong Kong International Arbitration Centre (1993–2016), Chairman of its Mediators Accreditation Committee (2002-2006); and the Founding Chairman of the Hong Kong Institute of Arbitrators (1997-2000).  He is a Chartered Arbitrator and listed in Hong Kong, London, Vancouver, Beijing and Shenzhen.  He is also a member of the International Council of Commercial Arbitration in Hague. In 2016 he was also appointed as arbitrator by the One Belt One Road (China) Arbitration Court.

 

Jazz Chow is a Director of Valuation & Advisory Services at CBRE, specialised in valuation of business enterprises, intellectual properties, intangible assets and wide range of financial instruments, for listed and private companies, for their IPO, merger and acquisition, financial reporting, management consulting and litigation purposes.
