In this breakfast seminar, Mark Herlach, Partner (United States) and Global Co-Head of Competition, Trade and Foreign Investments, and Jocelyn Chow, Partner (Hong Kong) and Head of Competition, Trade and Foreign Investment, Asia, of Eversheds Sutherland, will chair a panel discussion with industry leaders on the following topics:
• challenges brought by global sanctions, export controls and other trade regulation;
• the key legal, logistical and ethical considerations involved in decision making; and
• successful frameworks for managing risk identification and ensuring compliance.
This session will be highly relevant to any company engaging in cross-border business activities.
About the speakers

Jocelyn Chow is a Partner and Head of Competition, Trade and Foreign Investment, Asia, at Eversheds Sutherland, based in Hong Kong. She regularly advises clients on all aspects of competition law, economic and trade sanctions, import and export controls and other trade regulation as they apply to their commercial arrangements and business practices in Hong Kong, the PRC and other jurisdictions in the APAC region. She also has particular experience acting for regulators. Leveraging her subject matter expertise and language skills, Jocelyn regularly guides multi-national corporates through compliance matters, internal investigations and regulatory proceedings on the ground in Greater China, as well as advising clients on the design of their distribution models, supply chain management and compliance programmes in Asia.

Mark Herlach is a Partner and Global Co-Chair of Competition, Trade and Foreign Investment at Eversheds Sutherland, based in Washington DC. Mark’s practice focuses on energy, international trade and defence matters. He represents a broad range of clients, including corporations, advanced-technology companies and governments. He has guided clients in a broad range of complex matters, including international M&A, international boundary disputes, trade remedies and internal investigations relating to export control and sanctions compliance. Mark frequently speaks on energy, international trade and cybersecurity issues from a national and global perspective. He represents clients before the Committee on Foreign Investment in the United States (CFIUS), the US International Trade Commission, and federal agencies and courts throughout the country. Mark also currently serves on the roster of US panellists to resolve international trade disputes under the United States-Mexico-Canada Agreement, the successor to NAFTA.
