How the latest China Data Protection development impacts global businesses
Over the summer, China officially passed two pieces of key legislations that will change the future of the data protection landscape in China, and possible across the globe forever. The Data Security Law (“DSL”) of China was adopted on the 10 June and the Personal Information Protection Law (“PIPL”) of China was passed on the 20 August and will be implemented on the 1 September and 1 November respectively.
With significant administrative fines linked to non-compliance with the PIPL and the possibility of being prohibited from assuming managerial positions in relevant organisations for directly responsible persons, it’s vital to get ahead and stay compliant before full implementation.
At this hybrid event, experts from Bird & Bird will breakdown the multiple chapters and articles and explain the key elements of this first piece of comprehensive and dedicated personal information protection law in China. About the speakers
James Gong is a partner in Bird & Bird's Beijing office focusing on clients in the technology & communications space.He has extensive experience in advising on cross-border mergers and acquisitions, and general corporate and foreign direct investments issues. He has represented clients in a broad range of industries and specialize in technology, media, telecommunications, cyber security and data protection.
Clarice Yue is counsel in the Commercial team in Hong Kong and head of Data Protection group for China and Hong Kong. She is an experienced telecoms, media and technology lawyer with a substantial data protection practice.
Acting on behalf of clients including leading regional and international telecoms operators, media companies, multi-national technology companies, payments companies and institutional investors, Clarice has close to 20 years' experience advising clients on corporate, commercial and regulatory matters in the TMT sector. She also has extensive experience advising clients on data protection issues in the region.
Clarice is a frequent contributor to articles and publications on the evolving data protection regime in the region, in particular the China Cyber Security Law, and is a regular speaker on the subject.
She joined Bird & Bird in 2015 having worked in the Hong Kong office of another international law firm, and in 2003 also worked as in-house legal counsel when she was seconded to Exonomy, a B2B trading platform of Standard Chartered Bank.
Tiantian Ke is an associate in Corporate & Commercial Group based in Shanghai and a member of International Privacy & Data Protection Group, she advises Chinese and international clients on a range of data protection and cybersecurity issues in China and Europe, with a special focus on the TMT sector.
During her career she has been based in both London and Shanghai with a remit to develop China inbound and outbound work, which gave her an insight into the different approaches to compliance, regulation and enforcement in two jurisdictions, i.e. between China Cybersecurity Law and EU GDPR. She has been involved in providing data protection awareness training, drafting customer/employee-facing privacy documents, carrying out data protection compliance projects, reviewing data processing and cross-border data transfer agreements, responding to data subject right requests and data breach notification, and advising on cybersecurity law.
She has also worked with clients on investigating the privacy impact of new technologies and connected vehicles initiatives, which equipped her with better understanding of the fast-evolving industry.
