Managing Corporate Risks in Multi-jurisdictional Investigations

This presentation will cover managing corporate risks in multi-jurisdictional investigations and include investigations by the Serious Fraud Office in the UK of section 7 (failure of commercial organisations to prevent bribery) under the UK Bribery Act and other corporate “failure to prevent offences” recently introduced or in contemplation, and regulatory investigations in Hong Kong particularly by the SFC, both of regulated and listed corporates. 

 

About the speakers

Sir David Green CB QC is the former Director of the Serious Fraud Office in the UK and a Senior Consultant in Slaughter and May’s Dispute Resolution and Global Investigations Group in London. Following three years with the Defence Intelligence Staff, he was called to the bar in 1979. His practice over the following 25 years was in criminal law, acting for both defence and prosecution. He was appointed Recorder in 1997 and Queen’s Counsel in 2000. In December 2004 David was appointed Director of the newly established Revenue and Customs Prosecutions Office (RCPO) by the Attorney General. He remained in that post until RCPO was merged with the CPS in 2010. Thereafter he headed the CPS Central Fraud Group until 2011, when he returned to the bar. In April 2012 he was appointed Director of the SFO by the Attorney General, and his extended contract ended after six years in April 2018. David’s term at the SFO will be remembered for his refocusing of the office, his instigation and oversight of high profile investigations and prosecutions, the first Deferred Prosecution Agreements (DPAs) and his leadership of the SFO in a challenging political context. He was appointed CB in June 2011 and Knighted in June 2018.

 

Holly Ware is a partner in our Dispute Resolution and Global Investigations Group in London. She has a broad practice including litigation and contentious regulatory and criminal investigations. She has cross-jurisdictional investigation experience involving both regulatory and prosecuting authorities, including the LIBOR investigations and others relating to bribery and corruption, market abuse and money laundering.

 

 

 

 

Wynne Mok is a partner in Slaughter and May’s Dispute Resolution and Global Investigations Group in Hong Kong. She is a former Director of Enforcement at the Securities and Futures Commission in Hong Kong where her principal responsibilities included managing litigation involving the Enforcement Division. Wynne joined Slaughter and May in September 2018 and focuses on regulatory investigations and inquiries, commercial litigation, and securities investigations. Wynne has handled cases in a broad range of areas with a particular focus on commercial litigation, securities investigations, business ethics and anti-corruption, contentious trust and probate, and employment disputes. Wynne is an appointed Solicitor Advocate in Hong Kong and has been granted Higher Rights of Audience before the High Court and the Court of Final Appeal in civil proceedings in Hong Kong.
