The Hong Kong Competition Ordinance - 2nd Anniversary Key Developments and Looking Forward

Hong Kong’s Competition Ordinance, which took effect in late 2015, has now been in place for 2 years this month. On the 2nd anniversary of the Ordinance we look at what the new law has achieved so far, what judgements are in progress and we look ahead to the coming year and what businesses can expect to see from the Commission through 2018 as the law beds down in its third year.

We are delighted to have the new CEO of the Hong Kong Competition Commission, Brent Snyder as a guest speaker on our panel. The panel will be chaired by Freshfields Washington D.C. Counsel, Terry Calvani and our panellists will also include Alastair Mordaunt, Head of the Hong Kong Competition Group.

About the speakers

Brent Snyder was appointed to the position of Chief Executive Officer of the Competition Commission in September 2017.

Prior to joining the Commission, Brent served in the Antitrust Division of the United States Department of Justice from 2003 until 2017, first as a Trial Attorney prosecuting Division criminal matters, and as Deputy Assistant Attorney General (DAAG) since 2013 until 2017. In his capacity as DAAG, Brent headed the criminal enforcement function overseeing enforcement, prosecutions, leniency and other policy work. Between January and April 2017, he served as Acting Assistant Attorney General leading the Antitrust Division. Prior to joining the government, Brent practiced law at Paul Hastings in Los Angeles and Perkins Coie in Seattle where he was a Partner.

Brent played a key role in some of the Antitrust Division's most important investigations and trials in recent years, including thin-film transistor liquid crystal display panels, coastal water freight and air transportation. Brent has twice received the Attorney General's Award for Distinguished Service and he has been awarded an Antitrust Division Award of Distinction. He was also named a California Attorney of the Year in 2013.

Brent received his law degree from the University of Texas. He also holds a Bachelor of Arts degree in political science from Seattle Pacific University, where he graduated magna cum laude.

 

Alastair Mordaunt has more than 15 years of regulator and private practice experience, acting on both investigations and merger reviews. This includes four years at the UK’s Office of Fair Trading, originally as director of its mergers group and then director of a dedicated competition enforcement team.

Alastair’s practice covers competition-related work across Hong Kong, mainland China and the rest of the Asia-Pacific region. He previously worked at Freshfields’ offices in London, Brussels and Washington DC.

His extensive experience both at the regulator and as a private practitioner across three continents gives him a deep understanding of working effectively with regulators and devising successful strategies for his clients in the context of transactional and investigatory work.

Alastair is a frequent speaker at international conferences on competition matters, and has authored a number of publications on competition issues.

 

Terry Calvani focuses on civil and criminal investigations by US and international authorities and, as a result, has worked on some of the largest criminal cartel matters in recent history.

His experience includes representing clients during competition authorities’ reviews of mergers, acquisitions and joint ventures, and major grand jury proceedings. Terry also provides antitrust counseling to companies and trade associations, and is actively engaged in the defense of private antitrust actions.

Prior to joining Freshfields, Terry was commissioner as well as acting chairman of the US Federal Trade Commission. He was also a member of the board of the Irish Competition Authority and director of the Criminal Cartels Division.

Terry is a co-editor of Economic Analysis and Antitrust Law.

 

William Robinson is a hands-on, practical and creative commercial litigator who specialises in multijurisdictional disputes, investigations and regulatory issues.

In addition to commercial disputes, William’s practice spans a range of risk management issues, including: antitrust investigations and litigation, corporate crises and investigations, anti-bribery and corruption and sanctions issues.

William’s clients span a wide variety of sectors, including consumer products, food, tobacco, technology and private equity. His work is multinational and involves coordinating strategies across borders.

William has been based in Hong Kong since 2013 and leads the Asia Dispute Resolution group.

William studied and taught law at the University of Durham, UK, and worked for Judge Sir David Edward at the European Court of Justice, Luxembourg, between 1995 and 1999.  William is qualified in England & Wales and Hong Kong.
