In the aftermath of the 2008 Sanlu Dairy food safety incident, China's product liability regime has received a major overhaul in the continuing battle to address critical product safety problems. Companies who fail to take preventative measures in meeting existing and new laws and regulations, which impose strenuous compliance requirements against manufacturers and sellers can find themselves in considerable difficulty in an environment of increased regulatory oversight and, increasingly sophisticated consumers who are not afraid to seek remedies and compensation from manufacturers and sellers.
This presentation will outline the key legal, strategic, and practical considerations of being a manufacturer or seller in China as well as providing insights into best practice concerning your handling of product liability related issues in China. Key areas covered include:
- Introduction to product liability law in China.
- Damages: Is a viable recovery really possible?
- Influence of government on decisions.
- Future of product liability law in China: trends and unresolved problems.
- Recent case studies
Satpal heads up DLA Piper's China dispute resolution practice. With more than 16 years' experience in commercial litigation, he is a legal expert in dealing with PRC/FDI related disputes and investigations. Sammy is a senior member of DLA Piper's China dispute resolution practice, and heads its litigation and regulatory group in Beijing.
