On 4 January 2010, the PRC State Administration of Industry and Commerce and Ministry of Public Security jointly issued the "Circular on Further Strengthening the Administration on the Registration of Representative Offices of Foreign Enterprises". This circular has profound impact on both existing and newly setup representative offices (RO) in China. In particular, the new circular has restricted the number of representatives that can be registered for each RO.
Meanwhile, the PRC State Administration of Taxation issued the "Provisional Measures for the Tax Collection and Administration of ROs of Foreign Enterprises" on 20 February 2010. The new measures have fundamentally changed the long-established methodology for determining the tax filing basis of ROs under the old Foreign Enterprise Income Tax regime.
