Employee Terminations - a practical guide
Pattie Walsh
Partner, DLA Piper
Sponsored by

In the absence of any 'unfair dismissal' regime in Hong Kong, the termination of an employment contract is generally considered to be fairly straightforward.  However, the Employment Ordinance does provide remedies to employees on termination in certain circumstances.  Getting it wrong can be both expensive and time-consuming.

We will put the following key legal issues into a practical context with a focus on risk and tips to mitigate those risks from the perspective of a small business without dedicated HR support.

• Reasons for termination and procedural requirements
• Termination payments
• Notice periods and payments in lieu of notice
• Protected categories of employees
• Reorganisations
• Notifications on termination
• Confidential Information/Post-Termination Restrictive Covenants
• Providing references
